HR4681 Palestinian Anti-terrorism Act of 2006


This insidious legislation sponsored by Rep. Ileana Ros-Lehtinen (R-FL), essentially grants the United States permission to monitor and control thinking, reading, belief, politics, almost all aspects of life among the Palestinian people.

This legislation would, if passed, perpetuate forever the Ugly American in the Middle East. Just look at some of the items in the legislation --

(3) has agreed to work to eliminate anti-Israel
and anti-Semitic incitement and the commemoration 11
of terrorists in Palestinian society; 12
(4) has agreed to respect the boundaries and 13
sovereignty of its neighbors; 14
(5) acknowledges, respects, and upholds the 15
human rights of all people; 16
(6) conducts free, fair, and transparent elec- 17
tions in compliance with international standards; 18
(7) ensures institutional and financial trans- 19
parency and accountability; and 20
(8) has agreed to recognize the State of Israel 21
as an independent, sovereign, Jewish, democratic 22
state. 23
(b) AMENDMENTS.—Chapter 1 of part III of the For- 24
eign Assistance Act of 1961 (22 U.S.C. 2351 et seq.) is 25
amended— 26

(1) by redesignating the second section 620G 1
(as added by section 149 of Public Law 104–164 2
(110 Stat. 1436)) as section 620J; and 3
(2) by adding at the end the following new sec- 4
tion: 5
‘‘SEC. 620K. LIMITATION ON ASSISTANCE TO THE PALES- 6
TINIAN AUTHORITY. 7
‘‘(a) LIMITATION.—Assistance may be provided 8
under this Act or any other provision of law to the Pales- 9
tinian Authority only during a period for which a certifi- 10
cation described in subsection (b) is in effect. 11
‘‘(b) CERTIFICATION.—A certification described in 12
this subsection is a certification transmitted by the Presi- 13
dent to Congress that contains a determination of the 14
President that— 15
‘‘(1) no ministry, agency, or instrumentality of 16
the Palestinian Authority is controlled by a foreign 17
terrorist organization and no member of a foreign 18
terrorist organization serves in a ministry, agency, 19
or instrumentality of the Palestinian Authority; 20
‘‘(2) the Palestinian Authority has— 21
‘‘(A) publicly acknowledged Israel’s right 22
to exist as a Jewish state; and 23
‘‘(B) recommitted itself and is adhering to 24
all previous agreements and understandings 25

with the Government of the United States, the 1
Government of Israel, and the international 2
community, including agreements and under- 3
standings pursuant to the Performance-Based 4
Roadmap to a Permanent Two-State Solution 5
to the Israeli-Palestinian Conflict (commonly 6
referred to as the ‘Roadmap’); and 7
‘‘(3) the Palestinian Authority has taken effec- 8
tive steps and made demonstrable progress toward— 9
‘‘(A) completing the process of purging 10
from its security services individuals with ties to 11
terrorism; 12
‘‘(B) dismantling all terrorist infrastruc- 13
ture, confiscating unauthorized weapons, arrest- 14
ing and bringing terrorists to justice, destroying 15
unauthorized arms factories, thwarting and pre- 16
empting terrorist attacks, and fully cooperating 17
with Israel’s security services; 18
‘‘(C) halting all anti-Israel incitement in 19
Palestinian Authority-controlled electronic and 20
print media and in schools, mosques, and other 21
institutions it controls, and replacing these ma- 22
terials, including textbooks, with materials that 23
promote tolerance, peace, and coexistence with 24
Israel; 25

‘‘(D) ensuring democracy, the rule of law, 1
and an independent judiciary, and adopting 2
other reforms such as ensuring transparent and 3
accountable governance; and 4
‘‘(E) ensuring the financial transparency 5
and accountability of all government ministries 6
and operations. 7
‘‘(c) RECERTIFICATIONS.—Not later than 90 days 8
after the date on which the President transmits to Con- 9
gress an initial certification under subsection (b), and 10
every six months thereafter— 11
‘‘(1) the President shall transmit to Congress a 12
recertification that the requirements contained in 13
subsection (b) are continuing to be met; or 14
‘‘(2) if the President is unable to make such a 15
recertification, the President shall transmit to Con- 16
gress a report that contains the reasons therefor. 17
‘‘(d) CONGRESSIONAL NOTIFICATION.—Assistance 18
made available under this Act or any other provision of 19
law to the Palestinian Authority may not be provided until 20
15 days after the date on which the President has pro- 21
vided notice thereof to the Committee on International Re- 22
lations and the Committee on Appropriations of the House 23
of Representatives and to the Committee on Foreign Rela- 24
tions and the Committee on Appropriations of the Senate 25

in accordance with the procedures applicable to re- 1
programming notifications under section 634A(a) of this 2
Act. 3
‘‘(e) DEFINITIONS.—In this section: 4
‘‘(1) FOREIGN TERRORIST ORGANIZATION.— 5
The term ‘foreign terrorist organization’ means an 6
organization designated as a foreign terrorist organi- 7
zation by the Secretary of State in accordance with 8
section 219(a) of the Immigration and Nationality 9
Act (8 U.S.C. 1189(a)). 10
‘‘(2) PALESTINIAN AUTHORITY.—The term 11
‘Palestinian Authority’ means the interim Pales- 12
tinian administrative organization that governs part 13
of the West Bank and all of the Gaza Strip (or any 14
successor Palestinian governing entity), including 15
the Palestinian Legislative Council.’’. 16
(c) REPORT BY COMPTROLLER GENERAL.—Not later 17
than 180 days after the date of the enactment of this Act, 18
the Comptroller General of the United States shall submit 19
to the appropriate congressional committees a report that 20
contains a review of the extent to which United States as- 21
sistance to the Palestinian Authority under the Foreign 22
Assistance Act of 1961 or any other provision of law is 23
properly audited by the Department of State, the United 24
States Agency for International Development, and all 25

other relevant departments and agencies of the Govern- 1
ment of the United States. 2
SEC. 3. LIMITATION ON ASSISTANCE FOR THE WEST BANK 3
AND GAZA. 4
(a) AMENDMENT.—Chapter 1 of part III of the For- 5
eign Assistance Act of 1961 (22 U.S.C. 2351 et seq.), as 6
amended by section 2(b)(2) of this Act, is further amended 7
by adding at the end the following new section: 8
‘‘SEC. 620L. LIMITATION ON ASSISTANCE FOR THE WEST 9
BANK AND GAZA. 10
‘‘(a) LIMITATION.—Assistance may be provided 11
under this Act or any other provision of law to nongovern- 12
mental organizations for the West Bank and Gaza only 13
during a period for which a certification described in sec- 14
tion 620K(b) of this Act is in effect with respect to the 15
Palestinian Authority. 16
‘‘(b) EXCEPTIONS.—Subsection (a) shall not apply 17
with respect to the following: 18
‘‘(1) ASSISTANCE TO MEET BASIC HUMAN 19
HEALTH NEEDS.—The provision of food, water, 20
medicine, sanitation services, or other assistance to 21
meet basic human health needs. 22
‘‘(2) OTHER TYPES OF ASSISTANCE.—The pro- 23
vision of any other type of assistance if the Presi- 24
dent— 25
